General terms and conditions of business

Scope

The following terms and conditions apply to all orders placed through our online shop.

Contracting party, conclusion of contract

The purchase contract is concluded with Volpe Sp. z oo

By placing the products in our online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive another confirmation by email.

Contract language, contract text storage

The language available for concluding the contract is German.

We save the contract text and send you the order details and our General Terms and Conditions by email. For security reasons, the contract text is no longer accessible online.

Delivery conditions

Shipping costs are added to the stated product prices. You can find more information about shipping costs in the individual offers.

We only ship by mail. Unfortunately, pickup is not possible.

In our shop you can generally use the following payment methods:

credit card

When you place your order, you will simultaneously provide us with your credit card information. Once you have verified your identity as the legitimate cardholder, we will request your credit card company to initiate the payment transaction immediately after your order. The payment transaction will be processed automatically by the credit card company, and your card will be charged.

PayPal

During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, authenticate yourself with your login details, and confirm the payment instruction to us. After placing your order in the shop, we will request PayPal to initiate the payment transaction. The payment transaction will be processed automatically by PayPal immediately thereafter. You will receive further instructions during the ordering process.

Immediately

After placing your order, you will be redirected to the website of the online provider Sofort GmbH. To pay the invoice amount via Sofort, you must have an online banking account activated for participation in Sofort with a PIN/TAN procedure, verify your identity, and confirm the payment instruction to us. You will receive further information during the ordering process. The payment transaction will be processed immediately by Sofort, and your account will be debited.

Amazon Pay

During the ordering process, you will be redirected to the website of the online retailer Amazon before completing the order process in our online shop. In order to complete the order process via Amazon and pay the invoice amount, you must be registered there or register first and authenticate yourself with your login details. There you can select the delivery address and payment method stored with Amazon, confirm Amazon's use of your data and the payment instruction to us. You will then be redirected back to our online shop where you can complete the ordering process. Immediately after placing your order, we will request Amazon to initiate the payment transaction. The payment transaction is carried out automatically by Amazon. You will receive further information during the ordering process.

Purchase on account and financing via Klarna

In collaboration with Klarna AB (www.klarna.de) , Sveavägen 46, Stockholm, Sweden, we offer payment options for invoice purchase and installment purchase. Please note that Klarna invoice and installment purchase are only available to consumers, and payment must be made to Klarna in each case.

With Klarna's financing service, you can pay for your purchase flexibly in monthly installments of at least 1/24 of the total amount (but no less than €6.95). Klarna invoice

Retention of title

The goods remain our property until full payment has been made.

Transport damage

If goods are delivered with obvious transport damage, please report such defects to the delivery person as soon as possible and contact us immediately. Failure to file a complaint or contact us will have no consequences for your statutory rights and their enforcement, in particular your warranty rights. However, you will help us assert our own claims against the freight carrier or transport insurance.

Warranty and guarantees

Unless expressly agreed otherwise below, the statutory warranty law applies. The limitation period for claims for defects in used goods is one year from delivery of the goods. The above restrictions and shortened time limits do not apply to claims based on damage caused by us, our legal representatives, or vicarious agents.

  • in case of injury to life, body or health,
  • in the event of intentional or grossly negligent breach of duty or malice,
  • in the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations)
  • within the framework of a guarantee promise, as agreed or
  • to the extent that the Product Liability Act applies. Information on any additional warranties and their exact terms and conditions can be found with the product and on special information pages in the online shop.

Liability

We are always liable without limitation for claims based on damages caused by us, our legal representatives or vicarious agents

  • in case of injury to life, body or health,
  • in the event of intentional or grossly negligent breach of duty,
  • in the case of guarantee promises, if agreed, or
  • insofar as the scope of application of the Product Liability Act is open.

In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations), due to slight negligence on our part, our legal representatives, or our vicarious agents, liability is limited to the damage foreseeable at the time the contract was concluded, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr/. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Cancellation policy

Consumers have a 30-day right of withdrawal.

Right of withdrawal

You have the right to withdraw from this contract within 30 days without giving any reason.

The cancellation period shall be 30 days from the day on which you or a third party other than the carrier designated by you takes possession of the last goods.

To exercise your right of withdrawal, you must inform us (Volpe Sp. z oo, ul. Głogowska 41/8, 45-315 Opole, support@hexguard.eu) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You may use the attached model withdrawal form, but this is not mandatory.

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of return shipping costs and additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within 21 days from the day on which we received the goods. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any event no later than 14 days from the date on which you notify us of the cancellation of this contract.

The deadline is met if you send the goods before the expiry of the 14-day period. You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary to check their quality, properties, and functioning.

Unfortunately, letters and notes containing information other than the customer's name and the return order number cannot be processed. Customer service is available to assist you with any changes.

The right of withdrawal does not apply to the following contracts:

Contracts for the supply of goods which are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

Guidelines for customer product reviews

When writing a product review, please follow these guidelines: Focus only on the product you are reviewing and/or your actual experience using that product.

The review should not address customer service, shipping, or the purchasing process. If you have any questions/comments regarding these topics, please contact customer service directly.

State exactly what you liked or disliked about the product.

Remember that the purpose of a product review is to provide information to other customers who are considering purchasing the product.

Please note that all submitted product reviews are subject to the terms and conditions set out in our Terms and Conditions.

We reserve the right not to publish a product review if it contains any of the following:

  • - Any information not related to the actual product.
  • - Obscenity, defamatory language, or other language inappropriate for a public forum.
  • - Pricing, advertising, "spammy" content or references to other products, offers, websites or competitors.
  • - Email addresses, phone numbers, website links, physical addresses, or other forms of contact information.
  • - Critical or malicious comments about other product reviews published on the website or their authors.
  • - Any images that show improper use of the product.

Product reviews will not be published if the reviewer has no experience with the product. Product reviews must comply with all internal guidelines and be written in German.

As previously stated, please do not submit feedback regarding product selection, pricing, ordering, delivery, or other customer service issues through our product review system. Our customer service representatives will not see your feedback if you submit it through the product review system. Please contact customer service directly instead: support@hexguard.eu.

Conditions for redeeming discount vouchers for newsletter subscriptions:
The discount code can be used once and is valid for one month after subscribing to the newsletter. It cannot be combined with other promotions or discount codes. It cannot be exchanged for cash.

Special notes

If you finance this contract with a loan and later revoke it, you are no longer bound by the loan agreement, provided that both contracts form a single economic unit. This is particularly the case if we are also your lender or if your lender uses our cooperation to finance the loan. If the loan has already been paid to us when the revocation takes effect, your lender will assume our rights and obligations from the financed contract with you with regard to the legal consequences of the revocation or return. The latter does not apply if the subject matter of this contract is the acquisition of financial instruments (e.g. securities, foreign currencies or derivatives). If you want to avoid a contractual obligation as far as possible, exercise your right of revocation and also revoke the loan agreement if you are also entitled to a right of revocation for this.
